Here is what South Carolina law allows in 2026.
How does one get a medical marijuana card in South Carolina? You cannot, because no South Carolina law creates a medical marijuana card, a patient registry or licensed dispensaries. State law’s cannabidiol exception covers severe epilepsy, on a physician’s written certification under S.C. Code 44-53-110.
South Carolina has no medical marijuana card program, and both medical and recreational marijuana remain illegal. The Senate passed the South Carolina Compassionate Care Act in 2022 (S. 150) and 2024 (S. 423), but the House passed neither, and the 2025 bill, S. 53, is still in a Senate committee.
THE PENDING BILL AND THE CBD EXCEPTION
South Carolina physicians have no medical
marijuana card to certify you for

Until the law changes, South Carolina patients can follow the 2025 bill, S. 53, which has sat in the Senate Medical Affairs Committee since January 14, 2025.
However, South Carolina allows cannabidiol for Lennox-Gastaut syndrome, Dravet syndrome or another severe epilepsy that traditional therapies do not adequately treat. The product may hold no more than 0.9% THC and must hold more than 15% CBD.

To be eligible for medical CBD use in South Carolina, a patient needs a dated, signed written certification from a physician licensed in South Carolina (S.C. Code section 44-53-110). There is no card program and no state registry for this.

South Carolina keeps no patient registry, and medical marijuana remains illegal in the state. One exception is low-THC CBD for severe epilepsy, which needs a physician’s written certification stating the diagnosis and that the patient might benefit.
