Here is how getting a Florida medical marijuana card works for Lutz patients. The program behind that card rests on Amendment 2, approved by 71.3% of Florida voters in November 2016, under which a qualified physician may certify a patient with a debilitating medical condition. To get your Florida medical marijuana card, a qualified physician must first certify you after an in-person exam. Once you hold both the physician’s certification and a valid state ID card, Article X, section 29(a)(1) of the Florida Constitution says that medical use of marijuana “in compliance with this section is not subject to criminal or civil liability or sanctions under Florida law.” The same section sets its limits: medical use covers only amounts not in conflict with Department of Health rules (s. 29(b)(6)), the section gives no immunity under federal law (s. 29(c)(5)), and it does not permit driving or boating under the influence (s. 29(c)(4)).

Do I need to come in person, or can I get certified online from Lutz?

After examining you, a qualified physician may also certify you for another condition, such as some cases of anxiety, depression, migraines or neuropathy, if it is of the same kind or class as, or comparable to, one of the listed conditions other than a terminal condition or chronic nonmalignant pain; that decision is at the physician’s discretion, and certification is never promised.
