Texas Compassionate Use Program
Texas allowed low-THC cannabis through the Compassionate Use Act in 2015, at first only for patients with intractable epilepsy. The program has been expanded several times since then, most recently through HB 46, which took effect on September 1, 2025. HB 46 added chronic pain, traumatic brain injury, Crohn’s disease or other inflammatory bowel disease, and terminal illness or hospice or palliative care. It also requires DPS to license 15 dispensing organizations, up from three, and lets physicians prescribe inhaled aerosol or vapor when medically necessary.
The program is administered by the Texas Department of Public Safety through the Compassionate Use Registry of Texas (CURT). Texas does not issue a physical medical marijuana card; under Occupations Code 169.0011 the entry in CURT is the prescription. Your physician makes that entry, and a licensed dispensing organization looks it up in CURT when you show your photo ID at pickup. There is no separate state registration fee.
