Kentucky marijuana laws allow medical use only: since January 1, 2025, registered patients may buy at licensed dispensaries, while recreational use and home growing stay illegal. This guide covers Kentucky cannabis laws on possession, purchase limits, visitors and who qualifies.
Is Marijuana Legal in Kentucky?
At this time, marijuana in Kentucky is illegal for any kind of recreational usage. Medical use is legal for registered patients under KRS Chapter 218B. Specifically, Kentucky marijuana laws now let registered patients buy medical cannabis at licensed Kentucky dispensaries, up to a 30-day supply every 25 days.
Is Medical Marijuana Legal?
Yes. Medical marijuana has been legal in Kentucky since January 1, 2025, under Senate Bill 47, which Governor Andy Beshear signed on March 31, 2023. An earlier 2022 executive order pardoned possession of up to eight ounces bought in another state for people with one of 21 listed conditions; Executive Order 2026-361 ended that pardon on July 1, 2026.
To qualify for medical marijuana in Kentucky, patients need a written certification, after an in-person exam, from a medical marijuana doctor or APRN licensed and authorized in Kentucky. The practitioner must confirm a qualifying condition and a likely benefit from medical marijuana treatment.
Is Recreational Marijuana Legal?
No. Recreational cannabis is illegal in Kentucky, and licensed dispensaries sell medical cannabis only to cardholders and qualifying visiting patients.
When Will Medical Cannabis Be Available in Kentucky?
Medical cannabis is available in Kentucky now: licensed dispensaries began selling to cardholders in December 2025, and the state list showed 24 operating locations on October 8, 2026. On June 14, 2022, Governor Beshear created the Team Kentucky Medical Cannabis Advisory Committee by Executive Order 2022-338; it held town halls, took over 3,000 comments on its website and backed legalization.
Kentucky Marijuana Laws on Buying and Possessing
This section covers how much a Kentucky cardholder may buy and keep, and what the law allows for everyone outside the program.
Possession & Purchase
Possessing or buying cannabis in Kentucky is an offense unless you are a registered cardholder buying from a licensed dispensary. For anyone else, possessing any amount of marijuana is a Class B misdemeanor with no more than 45 days in jail (KRS 218A.1422), and trafficking in less than eight ounces is a Class A misdemeanor for a first offense, while a repeat offense or a larger amount is a felony (KRS 218A.1421). The exception is registered patients within their limits: a 30-day supply at home and a 10-day supply on their person.
How Much Can I Buy and Possess?
Registered patients may buy up to a 30-day supply every 25 days: 112 grams of raw plant material, 28 grams of concentrate or 3,900 mg of THC in infused products. Visiting patients may buy a 10-day supply every 8 days.
Where Can I Obtain Cannabis?
Kentucky cannabis laws allow sales only at dispensaries licensed by the Office of Medical Cannabis, to cardholders who show their card.
Who Can Legally Purchase Cannabis in Kentucky?
Registered patients 18 and older, designated caregivers and qualifying visiting patients may buy at licensed dispensaries.
Home Cultivation
The cultivation of marijuana is illegal in Kentucky except by licensed cultivators, and a medical cannabis card does not allow home growing.
Reciprocity
Kentucky does accept out-of-state medical cannabis cards from visitors 21 and older who also carry proof of a qualifying diagnosis.
Consumption
Kentucky marijuana law forbids the consumption of cannabis, except by registered patients with qualifying conditions, who still may not smoke it.
Where Can I Safely Consume Cannabis?
It is illegal to consume cannabis in Kentucky unless you are a registered patient with a qualifying medical condition or a qualifying visiting patient. Vaping is banned on public transportation and in public places, and smoking is banned everywhere.

Kentucky law and Executive Order 2026-318 together cover the conditions below; the executive order conditions may qualify when a symptom that is itself a statutory qualifying condition is diagnosed or confirmed by the practitioner. The conditions are as follows:

- Chronic nausea or cyclical vomiting syndrome

- Muscle spasms or spasticity
- Muscular dystrophy
- Huntington’s disease
- HIV or AIDS
- Glaucoma
- Terminal illness
How to Obtain a Medical Card?
The Kentucky medical marijuana card program opened on January 1, 2025: see an authorized practitioner in person, then apply online with the Office of Medical Cannabis and pay the $25 fee. Cards last up to one year.
Kentucky’s marijuana laws are still in a state of evolution: on February 5, 2026 the Office of Medical Cannabis recommended to legislative leaders that the qualifying conditions be expanded, and Executive Order 2026-318 of June 2, 2026 clarified that 15 more conditions may qualify through a symptom already on the statutory list.
