Fort Myers patients are certified under a program that rests on Amendment 2, which Florida voters approved on November 8, 2016 and which is now part of the Florida Constitution. For a Fort Myers patient with a qualifying condition, the steps run in this order: a qualified physician certifies you, the physician enters the certification in the state registry, and then you apply to the OMMU for your ID card. Once you hold a physician certification together with a valid state ID card, the Florida Constitution says in Article X, section 29(a)(1) that medical use of marijuana “in compliance with this section is not subject to criminal or civil liability or sanctions under Florida law.” The section sets limits too: under section 29(b)(6), only an amount “not in conflict with Department rules” is medical use; nothing in the section offers federal immunity (s. 29(c)(5)); and section 29(c)(4) does not permit operating any vehicle, aircraft, train or boat while under the influence of marijuana. How Florida Qualifies Physicians
In Florida, only a qualified physician may certify a patient for medical marijuana. The statute’s own wording, in section 381.986(1)(n), is that a qualified physician is “a person who holds an active, unrestricted license as an allopathic physician under chapter 458 or as an osteopathic physician under chapter 459 and is in compliance with the physician education requirements of subsection (3).” Put simply, the role is open only to an MD or DO holding an active, unrestricted Florida license, and subsection (3)(a) requires that physician to successfully complete a 2-hour course and subsequent examination before approval and again ahead of each license renewal. The physician who examines you at Winkler Ave is held to that rule like every other qualified physician. The Office of Medical Marijuana Use publishes the qualified physician list, which it says is updated every Friday, so you can look up a Fort Myers doctor on it before you book. At each certification the patient signs the informed consent form Florida’s medical boards require, which covers the negative health risks of smoking.
