Is Medical Marijuana Legal in Milwaukee, WI?

Medical marijuana is not legal in Milwaukee: Wisconsin issues no medical marijuana card, though a physician licensed in Wisconsin may certify a CBD product for a medical condition. The latest bill, SB 534, had a Senate committee hearing in October 2025 and failed to pass on March 23, 2026. Hemp, including hemp-derived CBD, is legal under Wis. Stat. 94.55.
A future program would need a new law, since every medical and adult-use bill of the 2025 to 2026 session failed to pass. The state keeps no patient registry, so there is no card to apply for online. Marijuana possession remains a crime in Wisconsin. Cards from Minnesota, Iowa, Illinois or Michigan give no protection in Wisconsin, which recognizes no out-of-state program. No card makes marijuana concentrates, vapes or edibles legal to buy in Milwaukee.
Milwaukee County’s ordinance cannot be used once a state complaint alleges more than 25 grams, or any amount after a Wisconsin possession conviction, unless both conditions in Wis. Stat. 59.54(25)(a) are met: the state charge is dismissed or not prosecuted, and the city, village or town where it happened has no marijuana possession ordinance of its own or has also dismissed or not prosecuted its own case. Under state law, a repeat possession offense is a Class I felony, with up to 3 years and 6 months in prison. Any earlier drug conviction, state or federal, counts as a prior.

What Does Wisconsin Law Mean for Marijuana Doctors in Milwaukee?
Dr. Green Relief has no office in Wisconsin. Its clinics are in Florida and Las Vegas, Nevada. Any Milwaukee physician licensed in Wisconsin may issue a CBD certification letter. Wis. Stat. 961.32(2m) sets out what it must contain, including its issue date. That letter must name the physician and the patient and is good for up to one year. Hemp-derived CBD that meets the hemp THC limit needs no letter at all.
Wisconsin law names no qualifying conditions, so no diagnosis unlocks marijuana in Milwaukee. SB 534 would have covered cancer, epilepsy, glaucoma, multiple sclerosis, Parkinson’s disease, inflammatory bowel disease and terminal illness. Because the bill failed, none of those conditions qualifies anyone for marijuana today.

Milwaukee follows the same rule as the rest of Wisconsin: there is no medical marijuana program, so no physician here or elsewhere can certify you for medical cannabis. A Wisconsin-licensed physician may certify a CBD product for a medical condition, and that letter is valid for up to one year. It covers that CBD product only, never marijuana, which remains a crime under Wis. Stat. 961.41 in Milwaukee as everywhere in the state.
